Client Service Agreement

Terms and Conditions

Trading as Pawsome Pet Services

Parties & Scope

  1. The Pawsome Group Pty Ltd (including its directors, employees, and independent contractors, collectively referred to as "Pawsome", "We", "Us", or "Our Personnel").
  2. The Client (the pet owner or authorised agent, referred to as "You", "Your").
  3. This agreement applies to all current and future pets owned by You and remains in effect for all services rendered.

Our Commitment & Liability

  1. Standard of Care: We agree to provide services in a reliable, caring, and professional manner.
  2. Waiver of Liability: You expressly waive all claims against Pawsome and its Personnel, except those arising from gross negligence. Independent contractors are covered under Pawsome's insurance policy.
  3. Home Security & Pet-Proofing: You are responsible for "pet-proofing" your property and ensuring the security of all fences, gates, and latches. Pawsome is not liable for the injury, disappearance, or death of any pet with unsupervised access to the outdoors.

NSW Legal Compliance & Control

  1. Registration & ID: You certify your pet is microchipped and wears a collar with ID as per the NSW Companion Animals Act.
  2. Effective Control: Pawsome will maintain "effective control" of your dog as per Section 13 of the Act. You must disclose if your dog has been declared "Dangerous", "Aggressive", or "Restricted" by any NSW Council.

Payment Terms (Post-Payment)

  1. Invoicing: Invoices are issued weekly following the completion of the service period.
  2. Due Date: You agree to pay all invoices immediately upon receipt.
  3. Late Payments: If unpaid after 2 business days, a $20.00 Late Administration Fee applies. Interest may be charged at 15% per annum (calculated daily).
  4. Right to Suspend: If payment is 7 days overdue, all services will be suspended until the account is settled. You remain liable for all debt recovery and legal costs.
  5. Methods: Payment via direct debit, bank transfer, or other options provided on your invoice.

Cancellations & Termination

  1. Notice: 24 hours' notice is required for any cancellation.
  2. Late Fee: Cancellations with less than 24 hours' notice may incur a $40.00 (inc. GST) fee.
  3. Safety Termination: Pawsome may terminate this contract with 24 hours' notice if a pet is deemed a safety risk.

Behaviour, Reactivity & Personnel Safety

  1. Disclosure: You must disclose any history of reactive, aggressive, or territorial behaviour (e.g., lunging, snapping, biting) toward people or other animals.
  2. Our Personnel Safety: Pawsome maintains a zero-tolerance policy for verbal abuse, harassment, or physical threats directed at Our Personnel by Clients or their associates.
  3. Safe Environment: You must ensure your property is safe for Our Personnel to enter. We reserve the right to cease Services immediately if the safety of Our Personnel is compromised.
  4. Indemnity: You are personally liable for all damages, medical, or veterinary costs arising from an injury caused by Your pet to Our Personnel, other animals, or third parties.

Property, Emergencies & Limitation of Liability

  1. Damage: Pawsome is not liable for damage caused by the pet to Your property (e.g., chewing, digging, accidents) or factors beyond our control (e.g., leaks, storms).
  2. Pet Fatality: While We exercise the utmost care, You acknowledge that pets may be subject to sudden illness, injury, or death due to natural causes, undiagnosed medical conditions, or inherent risks of animal behaviour. You agree that Pawsome and its Personnel shall not be held liable for the death of any pet while in Our care, provided We have acted without gross negligence.
  3. Protocol for Deceased Pets: In the unexpected event that a pet passes away while in Our care and You or Your emergency contacts are unreachable, You authorise Pawsome to transport the pet to Your nominated Veterinarian (or the nearest available veterinary facility). Pawsome will request that the Veterinarian hold Your pet until You can be reached. You agree that any costs associated with the transport, clinical storage, or subsequent cremation/funeral services are Your sole responsibility and must be settled directly with the veterinary facility or third-party service provider.
  4. Third-Party Access: You must notify Us if any other person (including cleaners, trades, friends, or family) will have access to the property during the scheduled service period. Pawsome is not responsible for pet escapes, security breaches, or the safety of the premises caused by third parties. For the safety of Our Personnel, We reserve the right to suspend or terminate a service if an unannounced person is present on the property.
  5. Key Security: Keys are coded for anonymity. You are responsible for any locksmith costs due to lock malfunction.

Weather & Emergency Evacuation

  1. Extreme Weather: Walks may be cancelled for heavy rain or extreme heat (where pavement may burn paws). An "In-Home Visit" will be offered as a substitute.
  2. Emergency Evacuation (Owner Away): In the event of a flood or bushfire while You are away, We may evacuate Your pet. You agree to reimburse Pawsome for all third-party boarding costs. An Emergency Evacuation Fee of $180.00 (inc. GST) per day applies for transport and coordination.

Privacy & Media

  1. Confidentiality: Your data is kept private unless disclosure is required by law.
  2. Marketing: You consent to Pawsome using photos/videos of your pet for marketing and social media.

Veterinarian Release & Consent

I authorise The Pawsome Group Pty Ltd to seek medical assistance for my pet(s) if they appear ill or injured.

  • I assume full financial responsibility for all veterinary services and emergency boarding.
  • I agree to pay any "Special Service Fees" (transport/supervision) immediately upon receipt of the invoice.
  • I release Pawsome from all liability related to the transportation and emergency treatment of my pet.

I acknowledge that booking a service with The Pawsome Group Pty Ltd constitutes full acceptance of these terms.
