Terms of Service
Pawsome Pet Services agrees to provide Services stated in this agreement in a reliable, caring and trustworthy manner. In consideration of the services as an express condition thereof, the client expressly waives and relinquishes any and all claims against Pawsome and its employees and independent contractors, except those arising from negligence. Claims of negligence that involve a Pawsome Carer will be the responsibility of the Carer. All hired independent contractors are insured with Pawsome.
You are responsible for pet-proofing Your house and yard, and the security of all fences/gates/latches etc. Pawsome will not be responsible for the safety of any pets and will not be liable for the injury, disappearance, death, or illness of any pet with unsupervised access to the outdoors.
1.0 Parties
1.1 Pawsome Pet Services (ABN 96 773 302 418) of 51 Toxteth Road, Glebe NSW 2037 and its employees and independent contractors (Carer, Pawsome, Our, Us)
1.2 The Owner of the pet(s) entering this agreement (I, You, Your)
2.0 Definitions
2.1 “Services” means any accepted booking.
2.2 “Pet(s)” means animals as legally Owned by You. You must have legal rights to place the animals in the care of Pawsome. The Carer cannot service a home with “Visiting” pets that do not belong to the Owner of the service site without separate sets of agreement forms, including a Service Agreement, accepted and signed by each rightful owner(s). The terms of this document apply to all the Pet(s) owned by You, including any and all new pets that You obtain on or after the date this document was signed.
3.0 Health
3.1 You certify that Your pet(s) listed above is/are up to date with their vaccinations, worming and flea/tick treatments and are in good health and have not been ill with any uncontrolled medical conditions.
4.0 Payment
4.1 Pre-payment: You agree that Services booked must be pre-paid for upon receipt of an invoice and prior to the commencement of Services, unless otherwise agreed.
4.2 Post-payment: In the event post-payment terms have been agreed, You agree that any invoices received for Services rendered are to be paid within 2 business days of receipt. Failure to make payment on time may result in an additional late payment surcharge of 15% of the outstanding amount being applied, or we may proceed to debt collection procedures and any future Services may be cancelled by Pawsome. Any costs in recovering unpaid monies owed to Pawsome will be at the Owner’s expense.
4.3 You understand that all payments are to be made to Pawsome either by cash or direct bank transfer. Banking details will be provided to You prior to commencement of Services.
5.0 Cancellations
5.1 You understand that the Carer is fairly flexible with changes to booking arrangements and You agree to give us 24 hours prior notice for any cancellation of any Scheduled Service(s).
5.2 Any cancellations made less than 24 hours prior to the commencement of Service will incur a cancellation fee of $25.00.
5.3 Cancellations can be made via the Pawsome Owner Customer Portal, phone, text message or email using the contact form located at www.pawsome-pet(s).com.au/contact/
5.4 Pawsome reserves the right to refuse or no longer provide Services to Your Pet(s) and terminate this contract if the Carer determines that Your Pet(s) poses a danger to the health or safety of itself, other pets, other people or the Carer. In this event, Pawsome will provide You with 24 hours notice, and any monies You have pre-paid for unused Services will be fully refunded within 14 calendar days.
6.0 Temperament
6.1 You hereby certify that Your pet(s) has/have not harmed or shown aggressive or threatening behaviour towards any person or any other animal.
6.2 The Carer reserves the right to remove at any time, an animal from its care if Your pet(s) exhibit behaviours which could potentially be harmful to other animals or people. You agree that You will be responsible for any costs associated with dealing with an aggressive pet(s).
7.0 Damages
7.1 You agree that whilst your pet(s) is in the care of Pawsome, that Pawsome is not responsible for damage to the home beyond the control of the Carer. This includes, but is not limited to leaks, electrical problems, and acts of nature. In these situations, Pawsome will attempt to contact You, and then the emergency contact before making a subjective decision on dealing with the problem.
All repairs and related fees (including Pawsome’s service time and associated coordination fees) will be discussed with You prior to booking and will be payable by You.
7.2 Pawsome is not responsible for any damage to property of the client or others unless such damage is caused by the negligent act of the Carer. Pawsome accepts no responsibility for security of the premises or loss if other individuals have access to a client’s home, or if the home is not properly secured.
7.3 Pawsome is not liable for any loss or damage in the event a burglary or other crime that should occur while under this agreement. You agree to secure home prior to leaving the premises. Pawsome will re-secure the home to the best of its ability at the end of each visit.
7.4 You understand and accept that You will be held responsible and personally liable for all damages and repairs.
7.5 You have home and contents insurance and agree that the Carer will not be held responsible for anything lost or damaged in Your home during the Service period including plants.
8.0 Pet Illness or Injury Emergency Plan and Unforeseen Circumstances
8.1 You agree that although the Carer will exercise the utmost care and diligence when providing pet(s) Services and caring for Your pet(s), that pet(s) can sometimes receive minor injuries or scratches whilst playing with other animals or during walks. You agree that the Carer shall not be held liable for the loss, injury, death, or actions of Your pet(s).
8.2 In the unlikely event that Your pet(s) is injured or showing signs of illness whilst in Pawsome’s care, Your Carer will make every effort to make urgent contact with You, or Your emergency contact(s) provided to Us should you be unreachable. You accept that if their pet(s) requires immediate veterinary treatment, you authorise your Carer to take Your pet(s) to Your family Vet/Animal Hospital, or the closest open facility if Your family vet is available i.e. (outside Clinic Opening Hours) for medical treatment.
8.3 You agree to complete and sign the Veterinarian Release & Consent provided to You, which will be given to the treating Vet/Animal Hospital in the event of a medical emergency. You agree to be financially responsible for the payment of fees and costs associated with the treatment of your pet(s) to the Vet.
8.4 You will be responsible for all medical expenses and damages resulting from an injury to a Carer or any other persons injured whilst your Pet(s) is in Pawsome’s care, that is the direct cause of Your Pet(s). You agree to indemnify, hold harmless, and defend Pawsome in the event of a claim by any person injured by Your Pet(s).
8.5 In the case of an unforeseen event such as more serious injury or illness of Your pet(s), You agree to cover all costs in relation to, but not limited to, Your Carer taking Your pet(s) to a veterinary clinic, employing the Services of a locksmith to gain access to Your property in an emergency, or retrieving a pet(s) at large.
8.6 You agree to notify Pawsome of any concerns relating to the condition of your Pet(s) or Property within 24 hours of your pet being in Pawsome’s care.
9.0 Privacy Statement
9.1 The Carer guarantees that any information that is provided to them will be kept confidential and will not be shared, sold or exchanged with any business or individuals not associated with Pawsome.
9.2 We may however, disclose any information about You and Your pet(s) to a law enforcement agency, or regulatory body should we be required by law to do so.
9.3 You agree to the use of photos or videos of your pet(s) taken in public areas to be used by Pawsome for any marketing or promotional purposes.
10.0 Waiver and Release of Liability
10.1 The undersigned releases Pawsome from all liability and indemnities Pawsome from any and all claims arising directly and indirectly from Your pet(s) participation in activities or use of Service(s), including any legal claims and medical expenses.
11.0 Security Alarms and Key Release
11.1 You understand Your Carer has cleared Police Checking and carries Public and Products Liability Insurance cover. These documents can be made available for Your viewing at any time.
11.2 You agree to provide keys and share any home security/alarm information with the Carer providing You with Services.
11.3 You agree to provide clear instructions on the operation of any Home Security Alarm Systems.
11.4 You agree to provide Pawsome with x2 sets of keys, one to be used for emergency / backup purposes.
11.5 Pawsome agrees to place an identifying code on Your keys. Your keys will not be marked with Your name or address. When not in use or prepared for use, Owner keys will be stored in a secure location by Pawsome.
11.6 Owner keys will be automatically retained by Your Carer at the end of each Service period. The Carer will place the key in a secured location until future Services are requested.
11.7 In the event that You are absent and the Carer is required to employ a locksmith or security alarm rm to gain entry into Your property due to malfunction of the lock, key or alarm – it shall be Your responsibility to pay for any associated costs.
11.8 You agree to arrange a suitable time with Pawsome to exchange keys. A non-refundable key exchange pick-up/drop-off fee of $15.00 [if distance travelled is between 3.0-4.99km] or $25.00 [if distance travelled is 5.0km or beyond] is chargeable if the Carer is required to travel beyond 0-2.99 km’s [Free] to You.
12.0 Inclement Weather (Extreme Heat, Ice, Snow, Thunder/Wind Storms, Cyclones)
12.1 Dog Walking Service
(i) For the safety of Your pet(s), we will not walk Your dog during heavy rain, thunderstorms, windstorms, heavy snow or extreme heat, if roads are icy or any weather we deem unsafe.
(ii) If, however You would still like us to visit Your Pet(s) at Home (without walk), we are willing to do so should conditions be safe for driving to Your Home – please discuss with Your Carer.
(iii) You will not be charged in the event weather intervenes and Pawsome makes the decision not to walk dogs for safety reasons. If an alternative Service is not provided (i.e. In-Home Pet visit) – a credit will be applied for any unused Service.
12.2 In-Home Pet Visits
(a) Clients with Service in Progress:
(i) If Pawsome have prior notice of such weather conditions, we will make necessary preparations in Your home to ensure that Your pet(s) have enough water, comfort, food and shelter in case Service modifications become necessary.
(ii) The scheduled Service (or Carer) may be changed, interrupted, or altered due to circumstances.
(iii) If it is not possible to drive safely to Your home, and we are initially unable to contact You immediately, Your pre-arranged emergency contact will be notified.
(b) Clients with Scheduled Service Pending:
(i) Please check with Your Carer prior to Your departure or scheduled Service date to discuss the situation/options.
(ii) If necessary, Your emergency contact will initiate Service, and Your Carer will continue/ complete Service as driving conditions improve.
(iii) If You or we cancel Service due to impending inclement weather, a full credit for future in- home Pet Visits will be issued for any pre-paid unused Service.
12.3 Natural & Manmade Disaster (Earthquake, Flooding, Bush Fires)
(a) Clients with Service in Progress:
(i) Assuming phone Service is operational, You will be notified by Your Carer that a disaster has occurred.
(ii) Your home and pet(s) will be checked as soon as possible. If road conditions are hazardous, Your emergency contact will be notified.
(iii) Any pet(s) in jeopardy and require evacuation from your property will be taken to a safe location (i.e. appropriate Boarding Facility) as soon as possible. If possible, please have available a crate or transport carrier for each pet(s). Please have current pet(s) photos and ID’s updated in the Pawsome Owner Customer Portal (which You can access from any mobile or internet connection). In the event Your pet(s) are moved for their safety, a daily Boarding rate of $120.00/night (this includes transporting Your pet(s) to/from your home)) will be chargeable to You.
(iv) The scheduled Service may be changed, interrupted, or altered due to circumstances.
(v) If necessary, please return home as soon as possible and call Your Carer immediately upon Your arrival.
(b) Clients with Scheduled Service Pending:
(i) Please do not leave town during or after a natural or manmade disaster until we have agreed to assume care. Check with Your Carer prior to any anticipated departure to discuss the situation/options.
(ii) If You or we cancel Service due to natural or manmade disaster, a full credit for future in-home Pet Visits will be issued for any pre-paid unused Service.
(ii) Homes and pet(s) for clients who are not presently in Service will not be visited unless under special arrangement.
12.4 Client
(a) Client or Carer Personal Emergency (Accident, Illness or Death in Family)
Emergency
(i) In the event You have a personal emergency and require Pawsome to care for Your pet(s), we will make every effort on short notice to provide Services for Your pet family. Please do not leave town until we have agreed to assume care. If You are already away when the emergency occurs, please make sure that we are contacted immediately and we are aware of Your changing situation. Once we agree to provide Service, we will continue caring for Your pet(s) until You notify us that You have returned home.
(ii) You will be responsible for all charges for Services provided, payable before You depart where possible or immediately upon Your return.
(iii) If Pawsome is unable to provide You with scheduled Service(s), please assist in making other plans and con rm any changes with Pawsome.
(b) Carer Emergency
(i) In the event Your Carer has a personal emergency while caring for Your pet(s) while You are away, we will assign a backup Carer to cover Your schedule and assign pet care responsibilities. We will attempt to notify You that the contingency plan has been activated. Depending on circumstances, Your designated Carer will resume Service as soon as possible.
In any of the above situations, the scheduled Service with Pawsome may need to be changed, interrupted, or altered due to circumstances. If necessary, Your pre-arranged emergency contact will be notified to assist in providing Service.
If You/we cancel Service due to personal emergency, a full credit will be issued for any pre- paid unused Service.
13.0 Supply of Food & Equipment
13.1 You are responsible for supplying the necessary, safety equipment/supplies needed for care of Your pet(s), including but not limited to a sturdy, well- t harness/halter/collar/leash, litter boxes, food, treats, cleaning supplies, medicines, pet food, crate, favourite toys, wet weather coat, pet transport carrier and cat litter.
I acknowledge that completion of this agreement indicates acceptance of the above terms, and must be submitted prior to commencement of any Services.
Veterinarian Release & Consent
During my absence, I authorise in the event my pet(s) appears to be ill, injured, or at significant risk of experiencing a medical problem whilst in the care and during service of Pawsome Pet Services, I give Pawsome Pet Services permission to seek medical assistance from a Veterinarian or closest Veterinary Hospital/Clinic. I understand Pawsome Pet Services work hard to prevent accidents and injuries, and that such problems may occur no matter how well a pet is cared for. I agree to allow Pawsome Pet Services to use their best judgement in handling these situations, and I understand that Pawsome Pet Services, its employees or independent contracts assume no responsibility for the actions and decisions of the veterinary staff, the health, or death of my pet(s).
I understand Pawsome Pet Services will endeavour to make urgent contact with me, or if I am unreachable, my emergency contacts.
I will assume full responsibility for the payment for any and all veterinary services rendered, including but not limited to diagnosis, treatment, grooming, medical supplies, and boarding. I also agree to be responsible for all Special Service Fees assessed by Pawsome Pet Services for emergency transportation, care, supervision, or hiring of emergency caregivers, and will pay such fees within 2 business days upon receipt of invoice.
If my family Veterinarian is not available, I authorise Pawsome Pet Services to transport my pet(s) to a veterinarian of choice and authorise treatment. If emergency care is needed after regular office hours, my pet(s) may be taken to the nearest Veterinarian Emergency Clinic/Hospital.
I agree that Pawsome Pet Services is released from all liability related to transporting my Pet to and from veterinarian and treatment for illness or emergency.
